710.5.5 (DRUGS AND THE LAW)

  1. Define the term legal paternalism.
  2. Explain how consequentialist and deontological frameworks can lead to different conclusions about the legitimacy of criminal prohibitions of a drug such as cocaine.
  3. Explain how the fuzzy boundaries associated with the term self-regarding actmake it possible for a deontologist to endorse at least some criminal prohibitions on drug possession.
  4. Examine the following proposition: As a matter of justice, American drug-possession laws are unjust. That is, the United States should decriminalize drug possession and should regulate the possession of drugs (through the use of civil and even criminal sanctions) along the same lines currently in place for alcohol possession.

710.5.6 (ADDICTION AS A DEFENSE TO CRIMINAL LIABILITY)

  1. Explain the Wilkey/Leventhal disagreement about the proper resolution of Moore.
  2. Moore wanted to have a psychiatrist testify to the jury that he was unable to control his urge for heroin. The psychiatrist’s statements, had they been admitted, would have been classified as expert testimony. Such testimony must be backed by scientific findings. What kind of findings might support the psychiatrist’s statements?
  3. Outline Bazelon’s rotten social background In doing so, explain how it addresses questions of criminal responsibility and also questions about rehabilitation.
  4. Imagine that a modern addict advances the kind of argument Moore proposed a generation ago. How should a court respond to it?
